SECTION 1: GENERAL PROVISIONS

Article 1233.

All obligations arise from a convention (agreement) or from the law. (Bw. 1313v., 1352; Rv. 102)

Article 1234.

Every obligation is to give, to do or not to do something. (Bw. 1235v., 1239v., 1314; Civ. 1101, 1126)

SECTION 2: OF OBLIGATIONS TO GIVE SOMETHING

Putting in default:

Article 1238.

The debtor shall be declared to have defaulted, either by summation or other such similar deed, or pursuant to the contract itself, which stipulates that the debtor shall be in default upon failure to perform within the stipulated time period. (Bw. 391, 413, 579, 1243, 1362, 1626, 1805, 1979; Rv. 1v.; Civ. 1139)

SECTION 5: OF CONDITIONAL OBLIGATIONS

Right to specific performance:

Article 1267.

The party, in favor of whom the obligation has not been performed, may elect to demand that the other party performs the obligation if this is possible, or seek resolution, with compensation of costs, damages and interest. (Bw. 1243v., 1480, 1517; Civ. 1184).
